Your Complete Guide to Land Title Registration in the Philippines

The land title registration process in the Philippines has been streamlined, allowing completion in just one visit, thanks to the Land Registration Authority's computerization program. This guide will help you navigate the steps required to secure your title, ensuring your ownership is legally recognized.


When you purchase a property, your journey doesn't end with payment and the notarized Deed of Absolute Sale. Registering the title in your name is crucial to secure your ownership and protect your investment.


The process is straightforward, though it can be time-consuming due to government bureaucracy. However, with the right preparation, you can confidently manage the steps involved.


Step 1: Gather Required Documents at the BIR Regional District Office (RDO)

Required documents include:

  1. Original and photocopies of the Deed of Absolute Sale

  2. Owner's Duplicate Copy of the Transfer Certificate of Title (TCT)

  3. Certified True Copy of the Tax Declaration for land and improvements

  4. Sworn Declaration of No Improvement or Certificate of No Improvement for vacant lots

  5. Tax Identification Numbers (TIN) of both the seller and buyer


In some cases, additional documents may be needed, such as a Special Power of Attorney (SPA) or a vicinity map.


Step 2: Assess Transfer Taxes

A BIR representative will calculate the Capital Gains Tax (CGT) and Documentary Stamp Tax (DST). The buyer and seller must agree on who will pay these taxes. The CGT is 6% of the property's selling price, zonal value, or fair market value, whichever is highest, while the DST is 1.5%.


Complete three copies of:

  • BIR Form 1706 for CGT

  • BIR Form 2000 for DST


Submit these at an Authorized Agent Bank (AAB) or the local Treasurer's Office where there are no AABs.


Step 3: Obtain Certificate Authorizing Registration (CAR)

File your documents at the BIR to receive the CAR, which includes:

  1. The original copy of the Deed of Absolute Sale stamped by the BIR

  2. Owner’s Duplicate Copy of the TCT

  3. Original BIR Forms 1706 and 2000, stamped

  4. Copies of the Tax Declaration for land and improvement


Step 4: Pay Transfer Taxes and Obtain Tax Clearance

Pay the transfer taxes and obtain a tax clearance at the Local Treasurer’s Office, submitting:

  1. Original and one photocopy of the Deed of Absolute Sale

  2. Photocopy of the Tax Declaration

  3. Official Receipt of Payment of Real Property Tax and Special Education Fund Tax for the current year


Step 5: Secure the New Land Title

Visit the Registry of Deeds to get the new Transfer Certificate of Title under your name. Ensure you have:

  1. Deed of Absolute Sale

  2. Transfer Certificate of Title

  3. Certificate Authorizing Registration

  4. Tax Clearance

  5. Tax Declaration

  6. Receipts for CGT, DST, Tax Clearance, and Transfer Fee


Important: Request a new Tax Declaration from the Local/Municipal or Provincial Assessor’s Office with:

  1. Deed of Absolute Sale

  2. Transfer Certificate of Title

  3. Transfer Tax Receipt

  4. Tax Clearance
